TERMS AND CONDITIONS

In using Great Video Productions clients agree to the following:

Payment Terms and Delivery Condition:

Great Video Productions expects 50% of final payment on signing of the contract and the final 50% on completion of production. Final payment is due before delivery of video or link download. Product will be delivered once final payment has been received and cleared. Payment by paypal, bank transfer or cheque. All cheques must be made payable to SKYLITE ADVERTISING STUDIO CO., LTD. Client is responsible for all expenses incurred by Great Video Productions during all stages of a production. Including but not exclusively: transport, food, accommodation, equipment hire, communication costs and media.On delivery of final product copyright will be transferred to the client, yet Great Video Productions will retain the right to use all approved footage for their own promotional purposes. This may exclude any third party material (e.g. Music). The customer’s requirements must be clearly provided to Great Video Productions in writing before commencement of work. Any subsequent changes must also be provided in writing and then approved by Great Video Productions and may incur further cost.

Approval and Termination:

A video programme will only be publicly released by Great Video Productions once the customer approves all content as complete and satisfactory and confirms this in writing.  A customer may terminate the contract at any time by written email notice of termination. When a customer terminates the contract, they will remain liable to pay in full for all work previously undertaken and in progress by Great Video Productions unless any other written agreement is reached in advance. Great Video Productions reserves the right to refuse to use, publish or broadcast any information it considers obscene or morally unsuitable or which would breach copyrights, or which is libellous, defamatory or illegal. Great Video Productions cannot be held liable to any party for any errors on any medium after the customer has agreed in writing that the content is correct and accurate and should be posted, published or broadcast. E-mail correspondence shall be sufficient to prove changes to agreements for the form and content of programmes as long as it is acknowledged with a response.

Failure to meet the Deadline:

Great Video Productions will not commence work on any project until a signed purchase order or equivalent signed document has been provided by the client. Any confidential or proprietary information which is acquired by Great Video Productions from a client company, person or entity will not be used or disclosed to any person or entity, except when required to do so by law. If required, Great Video Productions will sign and adhere to the conditions of any Confidentiality Agreement used by the client. Any contract requiring Great Video Productions to work to specific deadlines provided within the written agreement will be deemed to include a provision that the clients will make themselves reasonably available to communicate with Great Video Productions. If Great Video Productions deem them not to of been so then Great Video Productions cannot be held responsible for failing to meet a deadline.

Claims and Cancellation:

Great Video Productions office hours are 9.00 a.m. to 5.30 p.m. Monday to Friday unless otherwise notified.  Any claims must be made in writing to Great Video Productions within 7 days of receipt of goods. If no claim is made within this period the client is deemed to have accepted the goods at the agreed price. Great Video Productions shall be under no liability if unable to carry out any provision of the contract for any reason beyond its control including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power supply, lock-out, strike or other action taken by suppliers or owing to any inability to procure materials required for the performance of the contract. During the continuance of such a contingency the client may, by written notice to Great Video Productions, elect to terminate the contract and pay for work done and materials used but subject thereto shall otherwise accept delivery when available.

Formats, Material and Storage:

Great Video Productions offer a number of options for exporting content. Usually we will export High Definition .MOV footage and compress to a number of specific formats to be burned to DVD. The formats we compress to are .MOV, H.264, MPEG-4, MPEG-2, MPEG-1, FLV and AVI. We burn compressed footage to single layer DVDs as Data discs. If the full HD version of the footage is required this must be specified before shooting and an external hard drive must be provide to Great Video Productions so that we can transfer the copy to the drive. If this is not convenient we can arrange a meeting to transfer the footage. If no specified format is agreed on .MOV, H.246 and MPEG-4 formats will be used.We can export footage to a variety of frame rates including 24, 25, 29.97, 30. Clients are entitled to one copy of each format of the video. If more are required there is a small additional charge. Great Video Productions will store a copy of each project in its database. However only the final copy. We delete all other files after completion including individual video files, audios files, program files and save files. Project videos saved on our database can be requested and sent at any time for a small additional charge.

Clients:

You must be an individual of 16 years of age or older to use our services unless with a legal guardians permission. If you are not yet 16 years old, please allow your legal guardian to contact us on your behalf. If you are at least 16 but not yet 18 years of age: Please have your parents or legal guardian review these Terms and Conditions with you, discuss any questions you might have, and give you their permission to use our services with both your and their full understanding of these Terms and Conditions. By using  our services, you are telling us that you and your parent or guardian have joined in this agreement. If you are a parent or guardian: Parents and guardians are advised to exercise supervision over their children’s on-line activities. If you do not agree to these Terms and Conditions, do not let your child use the Services. If you have any further questions about our services please take a moment to talk with live support agents or contact us via the contact page on our website. If you are the parent or guardian of a child under 16 and believe that he or she is using the services, please contact us. Parents/Guardians – it’s up to you to keep an eye on your child’s viewed content on the Internet. Great Video Productions is not responsible for monitoring or filtering its content, some of which, on rare occasions may not be appropriate for children under age 18. Notice to parents/guardians: Portions of the Great Video Productions site may potentially include content, which contains “R-rated” material, which may comprise nudity, violence or mature subject matter. Great Video Productions assumes no responsibility for filtering the content viewed by its members; accordingly minor members’ parents or guardians shall be solely responsible for filtering and/or monitoring their child’s use of the Great Video Productions Site and/or Services.

Links, External Sites and Recourses:

The Services and certain Submissions may contain, and other users or third parties may provide, advertisements for or links to other World Wide Web sites or resources. These sites and resources are not controlled by Great Video Productions, and the mere existence of the link on the Great Video Productions Site does not imply an endorsement or sponsorship by Great Video Productions. External Web sites and resources are not subject to these Terms and Conditions or the Great Video Productions Privacy Policy, and may be subject to other terms and conditions or policies posted therein. Because Great Video Productions has no control over such sites and resources, you acknowledge and agree that Great Video Productions is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Submission, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Great Video Productions shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any Submission, goods or services available on or through any external site or resource.
